These Terms of Service ("Terms") govern your use of the Launch mobile application, our website at launchnash.com, and related services (collectively, the "Services"), operated by Launch U LLC ("Launch," "we," "us," or "our"). By creating an account or using the Services, you agree to these
Terms and to our Privacy Policy.
1. Eligibility & Accounts
• You must be at least 13 years old to use the Services. Users under 18 must have permission from a parent or legal guardian.
• You agree to provide accurate account information and to keep your login credentials secure.
• You are responsible for all activity that occurs under your account.
2. Services & No Guarantee
Song evaluations, mentorship, and related offerings are educational services only. They do not guarantee publishing, recording, management, placements, contracts, or any commercial success.
3. Subscriptions, Billing & Cancellation
• Certain features require a paid membership. The price, billing frequency, and renewal terms are disclosed to you at the point of purchase.
• Paid memberships automatically renew for the same period until canceled.
• If you purchase through the Apple App Store or Google Play, billing and renewals are processed by that platform. You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• If you purchase through our website or payment processor (Stripe), you may cancel through your account settings or by contacting launchnashville@gmail.com.
• Cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
• If a free trial is offered, it will convert to a paid subscription unless you cancel before the trial ends.
4. User Content & Acceptable Use
• You retain ownership of content you submit, including songs, recordings, reviews, and profile information. You grant Launch a limited, non-exclusive license to host, store, and evaluate your submissions solely to provide the Services.
• You agree not to submit content that is unlawful, infringing, hateful, harassing, sexually explicit, or otherwise objectionable, or that you do not have the rights to share.
• Launch does not tolerate objectionable content or abusive users. You may report content or users by emailing launchnashville@gmail.com. We aim to review reports and remove violating content, or
remove or ban offending users, within 24 hours.
• We may remove content or suspend accounts that violate these Terms.
5. Account Deletion
You may delete your account at any time from within the app (Settings ® Account ® Delete Account) or online at https://launchnash.com/delete-account. Deleting your account removes your account and associated personal data, except information we are legally required or permitted to retain. If you have an active subscription billed through an app store, please cancel it through that store before deleting your account, as deletion may not stop store-billed renewals.
6. Copyright & DMCA Notices
Launch respects intellectual property rights. If you believe content available through the Services infringes your copyright, send a written notice to the contact below that includes: (a) identification of the copyrighted work; (b) identification of the material claimed to be infringing and where it is located; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act; and (f) your physical or electronic signature. We will respond appropriately, which may include removing the material and terminating repeat infringers.
7. Suspension & Termination
Launch may suspend or terminate accounts that violate these Terms.
8. Intellectual Property
The Launch name, logos, and app content are owned by Launch and may not be used without our
permission. This does not affect your ownership of your own submitted content.
9. Disclaimers & Limitation of Liability
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Launch is not liable for indirect, incidental, special, or consequential damages, and Launch's total liability is limited to the maximum extent permitted by law.
10. General Terms
• Force Majeure. Launch is not responsible for any failure or delay caused by events beyond its reasonable control.
• Assignment. You may not assign these Terms without our consent. We may assign them in
connection with a merger, acquisition, or sale of assets.
• Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
• Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Export Compliance. You agree to comply with all applicable export and sanctions laws and not to use the Services where prohibited.
• Entire Agreement. These Terms, together with our Privacy Policy and any applicable submission agreement, are the entire agreement between you and Launch regarding the Services.
11. Governing Law & Venue
These Terms are governed by the laws of the State of Tennessee, without regard to its
conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Davidson County, Tennessee.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date, and your continued use of the Services means you accept the changes.
